Miller Trust Guide

Disclaimer

This site and the kits sold on it are informational only. They are not legal advice and are not a substitute for consultation with a licensed attorney. We are not a law firm. We do not practice law. We do not draft legal documents. We do not host trust instrument text.

The kits teach families how to use their state's publicly-published Qualified Income Trust (Miller Trust) template — the template comes from the state Medicaid agency's official .gov website, not from us. We explain how to use the template, how to fund the trust, how to open the bank account, and how to avoid common denial reasons. We never apply legal judgment to your family's specific situation.

State Medicaid rules vary and change. The figures, policy sections, and procedures cited on this site reflect publicly-available state agency materials as of the "last reviewed" date on each state page. Verify all information directly with your state Medicaid agency and an attorney licensed in your state before acting.

Support is async email only. We do not offer phone consultations and we do not offer live chat. Email replies are limited to product/refund support and a canned redirect for any individualized situational question: "This kit is informational and we are not attorneys. We cannot give advice about your specific situation. For advice on your situation, please consult a licensed elder-law attorney in your state."

If you live in Florida, we do not currently sell a Florida kit. Florida's Unauthorized Practice of Law rules differ materially from other states and we have elected not to publish a Florida operational kit at this time.
