Miller Trust Guide

For the trustee, once the trust is running

Miller Trust Trustee Ledger

Setting up a Miller Trust is a one-time job. Running it isn't: every month the income has to go in, the allowed payments have to go out, and at renewal the Medicaid agency can compare the bank statements against what should have happened. This printable workbook gives the trustee one page per month to record it and check it.

  • 12 monthly pages. Deposits by source, each payment out with its date and reference, and an expected-vs-actual check against the bank statement.
  • "Your numbers" page. Every figure the months use, and where in your state guide or the agency's notice it comes from.
  • Annual summary and renewal checklist. A one-page view of the year, and the records to have together when the renewal packet arrives.
  • Built on a state's own check. The structure is modeled on the monthly reconciliation Colorado's Medicaid eligibility sites perform, generalized so it works in any income-cap state.

Questions

Do I need this to set up the trust?
No. Your state guide covers setting the trust up and funding it. The ledger is for afterward: the trustee's monthly record once the trust is running.
Does it work for my state?
It's the same workbook for every state that uses a Qualified Income Trust. Every state-specific figure is a blank you fill in from your own state guide or the agency's notices; nothing state-specific is printed in it.
My state has its own ledger form. Do I still need this?
Where your state publishes its own ledger or accounting form (Colorado does, for example), the state's form is the one that counts. This workbook is a working copy for keeping the month-by-month record that form is checked against.
Is this legal advice?
No. It's an informational record-keeping workbook. It doesn't calculate or decide any amount for you, and it isn't a substitute for advice from a licensed attorney in your state.

Informational only. This workbook is not legal advice and is not a substitute for consultation with a licensed attorney. We are not a law firm and we do not practice law. State Medicaid rules vary and change; verify all information with your state Medicaid agency and an attorney licensed in your state before acting.
